India Makes Final Anti-dumping Ruling On China's Industrial Laser Machines

A new round of trade wars has flared up in the world once again, and this time the spotlight has fallen between India and China.

According to the information released by the China Trade Remedy Information Network managed by the Trade Remedy Investigation Bureau of the Ministry of Commerce as of Oct. 7, India launched nine anti-dumping investigations against China from Sept. 20 to Sept. 30, within a short span of 10 days. Although India has been the country that implements the most anti-dumping measures against China, but a short period of time so intensively launched anti-dumping investigations against China, the density of its history is not rare.

A year ago, September 29, 2022, India's Ministry of Commerce and Industry issued a notice saying that, in response to the application submitted by India's domestic enterprise Sahajanand Laser Technology Limited, an anti-dumping investigation was initiated on industrial laser machines originating in or imported from China for cutting, marking or welding.

After a year, the results of the investigation India has been finalized. According to the China Trade Remedy Information Network released on October 10, 2023, September 27, India's Ministry of Commerce and Industry issued a notice on the origin or imported from China for cutting, marking or welding of industrial laser machines (Industrial Laser Machines, used for cutting, marking, or welding) The final anti-dumping ruling was made, recommending the imposition of anti-dumping duties on the Chinese products concerned for a period of five years, with duty rates ranging from 0% to 135.98% of the CIF, and the details of the duties imposed are set out in the attached table.

India topped the number of anti-dumping investigations against China

In recent years, with the rise of global trade protectionism, trade wars have become the norm in global economic and trade relations. India's anti-dumping investigations against China are but a microcosm of many trade wars. With the rapid development of bilateral trade between India and China, India launched anti-dumping investigations against China more and more frequently.

According to China's trade remedy information network as of October 7 released information, since September 20 to September 30, within a short period of 10 days, India intensively decided to launch 9 anti-dumping investigations on Chinese products, involving trichloroisocyanuric acid, soft magnetic ferrite cores, roller chains, cellophane film and other chemical raw materials, industrial parts and components and other products.

This is not India's first Chinese enterprises to "suppress". Previously, India has imposed anti-dumping duties on several products to deal with cheap imports from a number of countries, including China.

As early as May 6, 2022, India launched an anti-dumping investigation on single-mode optical fiber (customs tariff number: 90011000) originating from China, Indonesia, South Korea. According to the filing, the anti-dumping was initiated by Birla Furukawa Fibre Optics Prinate Limited ("BFL"), an Indian manufacturer, in respect of optical fibers originating from China, Indonesia and South Korea (hereinafter referred to as "Recipients The products include non-dispersion-shifted single mode optical fiber ("SMOF") originating in or exported from China, Indonesia and South Korea (hereinafter referred to as the "Recipient Countries"), where SMOF is used as a carrier to facilitate the transmission of a single spatial mode for the transmission of signals in a specific wavelength band. The product scope includes non-dispersion-shifted single-mode fibers (G.652) as well as bend-insensitive single-mode fibers (G.657), as defined by the International Telecommunication Union (ITU-T), with dispersion-shifted fibers (G.653), cutoff-wavelength-shifted single-mode fibers (G.654), and non-zero-dispersion-shifted fibers (G.655 and G.656) being explicitly excluded from the scope of the product.

In recent years, India has perennially dominated the top spot in the number of anti-dumping investigations against China. According to a Global Times reporter from the China Trade Remedy Network, managed by the Trade Remedy Investigation Bureau of the Ministry of Commerce, a total of 1,614 anti-dumping cases were filed against China globally from 1995 to 2023. Among them, the top three complaint countries/regions are India 298 cases, the United States 189 cases, the European Union 155 cases.

On August 30 this year, CCPIT released the global economic and trade friction index situation in the first half of 2023, which showed that India, the United States and Canada were the main initiators of China-related trade remedy measures in the first half of 2023, and had achieved full coverage from traditional labor-intensive industries to advanced technology fields. Among the anti-dumping investigations initiated by India against China, the top three industries were chemical raw materials and products industry, pharmaceutical industry and non-metal products industry.

According to the analysis of relevant sources, one of the main reasons why India has become the country that implements the most anti-dumping measures against China is India's ever-expanding trade deficit with China. In the trade dealings between China and India, for India its trade deficit with China is expanding, which makes the Indian government unilaterally think that China is constantly earning India's money, while India has been suffering losses. Under such a perception, how India will be polite to China? Anti-dumping investigations are actually just routine operations.

On the other hand, India may try to fight for more say in international trade by launching anti-dumping investigations. As a big developing country, India has been trying to enhance its position in the global economy and trade system. An anti-dumping investigation against China could put India in a more favorable position on the global trade stage.

In this context, the Indian government will continue to spare no effort to support the country's manufacturing sector, while increasing its efforts to curb imports of fast-growing Chinese products. Frequent initiation of anti-dumping investigations against Chinese imports and the imposition of a considerable degree of anti-dumping tariffs is an important means for the Indian government to realize its industrial planning.

How to respond to anti-dumping investigations?

Previously, India has already conducted anti-dumping investigations on China's steel, chemical, laser, photovoltaic and other industries, and the new round of investigations is undoubtedly a new challenge to China's related industries. For India's anti-dumping investigations, Chinese laser manufacturers and exporters can save for a rainy day, take the following measures to deal with:

1. Actively respond to the complaint: in the relevant countries of the investigating authorities to launch anti-dumping or countervailing investigations, the enterprises involved in the case should be fully prepared for the various preparations, within the time limit to actively respond to the complaint. Responding to complaints is the key to respond to anti-dumping investigations, if properly responded to, you can avoid being levied high anti-dumping duties, so as to maintain the competitiveness of products in the Indian market.

2. Adjust the export strategy: enterprises can take the way to adjust the export strategy to deal with anti-dumping investigation. For example, they can improve the competitiveness of their products in the Indian market by improving the quality of products, improving the packaging and reducing the cost. In addition, you can consider increasing the understanding of the local market in India, develop new products to meet local demand, so as to increase product sales in the Indian market.

3. Seek legal assistance: If the enterprise faces India's anti-dumping investigation, it can seek professional legal assistance. For example, you can contact the intermediary organizations or law firms in the relevant industries to seek professional legal advice and assistance.

4. Strengthen industry cooperation: Through strengthening cooperation with the same industry, share resources, information and technology, and jointly respond to anti-dumping investigations. For example, they can work together to raise funds, hire lawyers, and carry out technical research and development, so as to improve the ability of the whole industry to respond to anti-dumping investigations.

5. Exploit new markets: Consideration can be given to exporting products to other markets in order to reduce the degree of dependence on the Indian market. At the same time, it can also be through the development of new markets, increase the enterprise's sales channels, improve the profitability of enterprises.

In short, India's anti-dumping investigation against China, once again remind us that the complexity of the international trade environment requires us to be constantly vigilant and flexible strategy to deal with. At the same time, it also requires us to look for more opportunities for cooperation on a global scale in order to reduce our dependence on a single market. Only in this way can we maintain stable development in the ever-changing global trade environment.
